Planning and Environment Court

Appeals heard by the Planning and Environment Court

Appeals to the Court can be made about various matters including:

  • a development approval, including conditions or an infrastructure charges notice
  • decisions on requests to extend the relevant period for an approval
  • decisions on requests to change or cancel a condition on a development approval
  • the giving of an enforcement notice
  • decisions on compensation claims.

The building and development tribunal’s jurisdiction is currently limited to appeals against decisions on building standards assessed against the Building Act 1975 and certain vegetation clearing disputes, and provides an effective and low-cost way of resolving technical disputes.
